What Are My Options if I Am Facing Deportation?

Facing deportation can be overwhelming and frightening, but it’s essential to know that options may be available to help you stay in the United States. From applying for relief to challenging deportation in court, a range of legal avenues may be open depending on your specific circumstances. At Jeffrey Y. Bennett Law, we provide skilled assistance to those navigating deportation proceedings and seeking ways to protect their right to remain in the U.S.

1. Apply for Asylum

If you fear persecution in your home country due to race, religion, nationality, political opinion, or membership in a particular social group, you may be eligible for asylum. This application must demonstrate a credible threat of harm if you return to your country.

2. Cancellation of Removal

Cancellation of removal is an option for certain lawful permanent residents and non-permanent residents who meet specific criteria. For example:

  • Lawful Permanent Residents: Must have held green card status for at least five years and lived continuously in the U.S. for at least seven years.
  • Non-Permanent Residents: Must show that deportation would cause exceptional hardship to a U.S. citizen or lawful permanent resident spouse, parent, or child.

3. Adjustment of Status

If you are eligible for a green card, you may be able to adjust your status and remain in the U.S. This may apply if you have a close family member who is a U.S. citizen or permanent resident willing to sponsor you, or if you qualify through employment or other special circumstances.

4. Temporary Protected Status (TPS)

Some immigrants from countries facing ongoing armed conflict, natural disasters, or other crises may qualify for TPS. While TPS is a temporary measure, it can provide relief from deportation and work authorization for a specified period.

5. Voluntary Departure

If you choose voluntary departure, you may leave the U.S. on your terms within a set timeframe, avoiding the penalties associated with formal deportation. Voluntary departure can also make it easier to return legally in the future compared to a forced removal.
